Human Rights
Greta is a nudist and campaigner for human rights. She has decided to undertake a sponsored 50 mile walk along the famous beauty spot, the Pennine Way in Northern England, naked. She intends to walk naked as she believes the right to be naked in public is a fundamental human right. All money raised by the walk is to be to be given to the human rights organisation, Liberty. Greta has raised £50,000 in sponsorship. When she contacted the Northumbria police to inform them of her sponsored walk they warned her that if she walks naked she will be arrested as her actions will be indecent. Greta was shocked as she sees nothing indecent about the naked body and regards the human form as beautiful in its natural state.
Last Saturday Greta arrived to start her sponsored walk. She was naked except for her boots, socks, rucksack and sun hat. She was met by two police officers who asked her to put on some clothes. Greta refused on the grounds she was committing no criminal offence. She was then arrested and taken to the local police station. She was released without charge after 15 minutes but informed that if she continued with the sponsored walk naked she would be arrested again. Greta has abandoned the sponsored walk as she firmly believes in the inoffensiveness of the human body and will only undertake it if she can do so naked.
Advise Greta:
- as to whether she can commence proceedings against the Chief Constable of Northumbria in respect of her treatment by the police; and
- of any Convention rights that might be applicable; and
- of any remedies available to Greta
